The Value of an Association Attorney

Other than board volunteers, residents and your manager, your community's legal counsel can be one of the most important people involved in your association.

It is helpful to have an ongoing relationship with legal counsel so that he or she is reasonably familiar with important issues involving your community. Community association law can be very complex and ever changing; a good association attorney is knowledgeable in a wide variety of practice areas that can affect your association, including the following:

  • Premise Liability
  • Construction Warranty
  • Directors' Liability
  • Real Estate
  • Contracts
  • Architectural and Design Review
  • Insurance
  • Employment
  • Taxation
  • Environmental Law
  • Water Regulation
  • Collections and Foreclosure

Your attorney doesn't represent the board, individual board members, individual homeowners, any group of homeowners or the manager; he or she represents only the association.

In addition to acting on your association's behalf in legal matters, your attorney also advises the board on its responsibilities and obligations. As board terms expire, your attorney can help provide continuity in policy-making and operations for future boards.
