Are Your Association Rules Reasonable?


Your association has a number of rules and regulations that you ask homeowners and residents to observe so that the association can maintain its property values and quality of life. Associations may want to assess the reasonableness of their rules by following the guidelines below. If you believe a rule fails the "reasonable" test, you and your fellow board members may want to discuss how to improve it.

  1. The board makes every effort to enforce rules uniformly, taking into account the consequences.
  2. The board thinks developing rules for the sake of having rules is unnecessary. The board develops rules only if they're really necessary.
  3. All the rules are based on proper authority such as the association's governing documents and the rules do not conflict with local, State or Federal law.
  4. The board doesn't make rules specifically to limit homeowner activities. The board tries to ensure that each resident can enjoy the community free from the disruptive or harmful behavior of others.
  5. The board doesn't want to punish anyone. The board tries to make rules that encourage understanding and compliance.
